The reasoning behind this new development in UK immigration legislation under section 4C of the British Nationality Act of 1948, is based on the logic that individuals with British born mothers would theoretically have become British citizens at the time of birth, had women been given equal opportunities to pass on citizenship rights through decent, in the same way as men had.
Another dose of good news for current and prospective parents includes an opportunity for children born outside the United Kingdom to British citizens by descent and after 13 January 2010, can be registered under section 3(2) of the British Nationality Act of 1981, if an application is made at any time before the child’s 18th birthday.

If my sons father is a British citizen and he pays child support to him in America but is not on his birth certificate, is my son allowed dual citizenship, or does his father have to be on his birth certificate in order for it to happen? Paternity has already been established.

My mom was one of three children she was the middle child born in zimbabwe , My grandfather came out of the UK to work for a Private UK based Company in Zimbabwe .My mother was born in 1958. All of my first cousins have made application through this new ruling for British citizenship and have been successful and are now applying for British Passports. I need to know whether I can also apply for this .I do believe that Zimbabwe was under british rule at the time of my mothers birth 1958.
I would appreciate your feed back I am very interested in aquiring a British Passport but I need to have all the facts so that I can make an informed decision before I start with this application process. It is extremely expensive but I feel as if it is my Birth Right and I would like to pursue it .

I am a Portuguese National, I am residence of UK since Sep 1998. I went to India in 2004 to do my Graduation which ended in 2008, in between 2004 and 2008 I was coming to uk after every 6 months in summer holidays for 4 weeks. I finished my degree in July 2008 since then I have only been to India twice for 4 weeks. My passport was renewed in Sep 2008. I cant remember the exact months and dates I was away for before Sep 2008.
Can please anyone suggest that weather I am eligible to apply for British Nationality or not if I am then what do I do about the time I was absent during my studies which I do not know in exact dates.

Hello, My grandfather and grandmother were both british subject they died around 1970’s. On my father’s birth certificate he has british subject status.

Based on your Grandmothers birth in the United Kingdom, you would qualify for an Ancestral Visa. This is a 5 year Employment Category,multiple entry visa, allowing you to work and live in the United Kingdom. The pathway to obtain citizenship, would require your completing 5 years continious residency in the UK, and application for Indefinite leave to Remain (Permanent Residency). Completion of 12 months minimum on ILR, will allow for application for Naturalisation as a British Citizen.

I hope you can help. I am a British citizen and my partner is Australian. We have a child together that was born in Australia last December. They both arrived in the UK in May of this year. They both came here on a tourist visa and were currently waiting on our child a British passport as we applied for that last week.
I have recently found out that if my partner wants to remain in the UK then she has to fly back to Australia and apply for a new visa from there.
We have rang the home office and they’ve been no help at all. Is there any way in which she can stay on a more permanent visa without leaving the UK. We haven’t the finances to pay for flights back an forth to Australia and we don’t want our child to be away from both parents for too long.
If there is no other option than for her to go back to Australia then can you please advise us both on what sort of visa she will need. I have looked on the internet at spouse visas but that says you need to be together for 2 years and we have both been together since February of last year so not quite 2 years yet.
I have also looked at tier youth visas but that says you aren’t allowed any dependent children.

My mothers father (i.e. My grandfather) was a british citizen (now dead) and held a british birth certificate which I have on me.
My mother also held a british passport which has now expired.
Am I applicable for a british passport? If so, could you please advise me as to what forms I need to fill out and what supporting documentation I must supply.

Unfortunately as your mother was not physically born in the UK you are not able to claim a British passport through her.
You are able to apply for an Ancestral visa based on your grandfather being born in the UK. This is a 5 year visa which allows you to live and work in the UK.

Hi, Im 17yrs old. My parents immigrated legally to London in 1990, and have papers to prove this. Me and my older sister were born in hammersmith, uk. We have our birth certificates that are from hammersmith. We moved from the uk a few years after I was born and never returned.
