Another dose of good news for current and prospective parents includes an opportunity for children born outside the United Kingdom to British citizens by descent and after 13 January 2010, can be registered under section 3(2) of the British Nationality Act of 1981, if an application is made at any time before the child’s 18th birthday.

If my sons father is a British citizen and he pays child support to him in America but is not on his birth certificate, is my son allowed dual citizenship, or does his father have to be on his birth certificate in order for it to happen? Paternity has already been established.

My mom was one of three children she was the middle child born in zimbabwe , My grandfather came out of the UK to work for a Private UK based Company in Zimbabwe .My mother was born in 1958. All of my first cousins have made application through this new ruling for British citizenship and have been successful and are now applying for British Passports. I need to know whether I can also apply for this .I do believe that Zimbabwe was under british rule at the time of my mothers birth 1958.
I would appreciate your feed back I am very interested in aquiring a British Passport but I need to have all the facts so that I can make an informed decision before I start with this application process. It is extremely expensive but I feel as if it is my Birth Right and I would like to pursue it .

I am a Portuguese National, I am residence of UK since Sep 1998. I went to India in 2004 to do my Graduation which ended in 2008, in between 2004 and 2008 I was coming to uk after every 6 months in summer holidays for 4 weeks. I finished my degree in July 2008 since then I have only been to India twice for 4 weeks. My passport was renewed in Sep 2008. I cant remember the exact months and dates I was away for before Sep 2008.
Can please anyone suggest that weather I am eligible to apply for British Nationality or not if I am then what do I do about the time I was absent during my studies which I do not know in exact dates.

Hello, My grandfather and grandmother were both british subject they died around 1970’s. On my father’s birth certificate he has british subject status.

Based on your Grandmothers birth in the United Kingdom, you would qualify for an Ancestral Visa. This is a 5 year Employment Category,multiple entry visa, allowing you to work and live in the United Kingdom. The pathway to obtain citizenship, would require your completing 5 years continious residency in the UK, and application for Indefinite leave to Remain (Permanent Residency). Completion of 12 months minimum on ILR, will allow for application for Naturalisation as a British Citizen.

I hope you can help. I am a British citizen and my partner is Australian. We have a child together that was born in Australia last December. They both arrived in the UK in May of this year. They both came here on a tourist visa and were currently waiting on our child a British passport as we applied for that last week.
I have recently found out that if my partner wants to remain in the UK then she has to fly back to Australia and apply for a new visa from there.
We have rang the home office and they’ve been no help at all. Is there any way in which she can stay on a more permanent visa without leaving the UK. We haven’t the finances to pay for flights back an forth to Australia and we don’t want our child to be away from both parents for too long.
If there is no other option than for her to go back to Australia then can you please advise us both on what sort of visa she will need. I have looked on the internet at spouse visas but that says you need to be together for 2 years and we have both been together since February of last year so not quite 2 years yet.
I have also looked at tier youth visas but that says you aren’t allowed any dependent children.

My mother also held a british passport which has now expired.

Unfortunately as your mother was not physically born in the UK you are not able to claim a British passport through her.
You are able to apply for an Ancestral visa based on your grandfather being born in the UK. This is a 5 year visa which allows you to live and work in the UK.

Hi, Im 17yrs old. My parents immigrated legally to London in 1990, and have papers to prove this. Me and my older sister were born in hammersmith, uk. We have our birth certificates that are from hammersmith. We moved from the uk a few years after I was born and never returned. Thanks for your query.
If a child is born in the UK they will not automatically be entitled to claim British Nationality if the parent/s are holding temporary visas for the UK.
A temporary visa is any visa that has an expiry date. The child would be required to be added as a dependant on the back of the parent/s temporary visa and follow the same immigration route as the parent/s.
Only if the parent becomes settled (indefinite leave to remain/permanent residency) can the child then become British or if the parent is already settled and then the child is born in the UK.

Hi, my daughter is 11 years old and holds an ancestry visa. She has lived in the UK for nearly 9 years. Originally she was granted 4 year ancestry visa and then we reapplied for another 5 year visa. I hold a British passport by descent and her father also holds an ancestry visa. We are not married.
My first question is can we apply for a British passport for my daughter under section 3(5) or do we need for apply for ILR first?
My second question is, Her father also needs to either apply for an extension of his ancestry visa or ILR. The reason we are thinking of not going for ILR is we may leave the country at the end of the year for a period of two years or more. What will happen to his ILR

Your daughter has to follow her father’s route. He should apply for ILR and she is added as a dependant on his application.
Once they have ILR, they can spend up to 2 years outside of the UK, however it is recommended that they remain in the UK until they have their passports (usually 12 months after getting ILR).

As you were born in the UK this does not automatically entitle you to claim British nationality.
You could only have achieved this if your parent/s were ’settled’ at the time of your birth (settled referring to either holding permanent residency or indefinite leave to remain, or a British passport)
If your parents were only holding a temporary visa for the UK (a student visa as an example) then you would not have been eligible to claim British nationality, only a student dependency visa.

A baby born in the UK will require a visa unless one of the parents holds ILR / British Citizenship.
if the parents do not hold any immigration status in the UK, the baby is also considered to be in the UK illegally.

If your child’s birth certificate shows the father’s name and you can obtain a birth certificate for the Father, I believe your child will be in a position to obtain a British Passport.
