Thanks for your query.

If a child is born in the UK they will not automatically be entitled to claim British Nationality if the parent/s are holding temporary visas for the UK.

A temporary visa is any visa that has an expiry date. The child would be required to be added as a dependant on the back of the parent/s temporary visa and follow the same immigration route as the parent/s.

Only if the parent becomes settled (indefinite leave to remain/permanent residency) can the child then become British or if the parent is already settled and then the child is born in the UK.

Hi, Im 17yrs old. My parents immigrated legally to London in 1990, and have papers to prove this. Me and my older sister were born in hammersmith, uk. We have our birth certificates that are from hammersmith. We moved from the uk a few years after I was born and never returned. Can I claim British citizenship on the basis that my parents were legal in the uk and I was born there in 1994? If so how will it work and where can I get more info on this? Thanks a ton!

Many thanks for your query.

Unfortunately as your mother was not physically born in the UK you are not able to claim a British passport through her.

You are able to apply for an Ancestral visa based on your grandfather being born in the UK. This is a 5 year visa which allows you to live and work in the UK.

Hello,

I am an Australian Citizen and hold a current valid Australian passport.
I wish to get a British passport.
My mothers father (i.e. My grandfather) was a british citizen (now dead) and held a british birth certificate which I have on me.
My mother also held a british passport which has now expired.
Am I applicable for a british passport? If so, could you please advise me as to what forms I need to fill out and what supporting documentation I must supply.

Dear Alam

Your child may have a claim to British Nationality if you are a British National, his mother has an individual status in the UK and this should not affect your son if you are a British National.

I’m assuming that your childs father was born in the United Kingdom and attained his citizenship through birth. If this is the case, your child may be eligible for British Citizenship through descent.
